NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule lists the state and federal statutes requiring and authorizing the existence of the Division of Adult and Aging Services. These statutes include the following: a) Older Americans Act, Pub. L. No. 106-501, 42 U.S.C. Section 3001 et seq.; b) Utah Division of Aging and Adult Services, Section 62A, Chapter 3, Parts 101 (which requires the division to exist) and 104 (which authorizes the division to designate planning and Area Agencies, develop a state plan, and take primary responsibility for state activities relating to the Older Americans Act; c) Workforce Investment Act of 1998, 29 U.S.C. 2801 et seq.; and d) Social Services Block Grant, 45 CFR Parts 16, 74, and 96.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The statutes requiring this rule (see above) remain in effect and as a result, the rule must also remain in effect. Further, all of the other rules regarding the Division of Aging and Adult Services are dependent on this rule to remain in effect. Therefore, this rule should be continued.
