    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    This rule indicates amendments to the Annual Plans of the Area Agencies on Aging can only be made with approval of the Division and that any amendments need to be comply with the format and instructions given by the Division as indicated by Section 62A-3-104 and the Older Americans Act. Parts 104.1, 104.2 and 104.3 require the Division to over see contracts with local area agencies, develop funding distribution formulas, and oversee background checks for personal care attendants.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    There has been no opposition to the rule. The rule is required to comply with Section 62A-3-104 and the Older Americans Act. Therefore, this rule should be continued.
