Nutrition Programs for the Elderly is created under the authority of the Older Americans Act of 1965 as amended in 2000 which authorizes state units on aging to provide nutrition programs for the elderly via area agencies on aging. This rule describes the mechanisms for implementing that process. This rule is developed under authority of Section 62A-3-104.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule details how the nutrition program for the elderly is to be implemented by the local area agencies on aging, and insures that the activity is in compliance with the cited federal regulation. Therefore, this rule should be continued.
