    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    The Utah Caregiver Support Program is created under authority of the Older Americans Act of 1965 as amended in 2000 which provides for federal funding to be passed through the state to Area Agencies on Aging to coordinate the delivery of support services to family caregivers of frail older individuals. This rule describes the requirements that are to be met to comply with the federal regulations. The rule is developed under authority of Section 62A-3-104.

     

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received.

     

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule details how the caregiver support program is to be implemented by the local area agencies on aging, and insures that the activity is in compliance with the cited federal regulation. Therefore, this rule should be continued.
