    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 13-2-5(1) grants the Division Director authority to issue rules to administer the Uniform Debt-Management Services Act. Subsection 13-42-112(2) requires the Division to make rules designating the states in which a debt-management provider may have a license or certificate that may be submitted to meet the registration requirements of the Uniform Debt-Management Services Act.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments were received in support of or opposing the administrative rule.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    Continuation of the administrative rule is necessary for the Division to administer and enforce the Uniform Debt-Management Services Act. The administrative rule is required in order for the Division to recognize the registration of debt-management providers registered in reciprocal states.
