NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 13-2-5(1) grants the Division Director authority to issue rules to administer and enforce the Utah Health Spa Services Act. Subsection 13-23-5(1)(a)(iii) requires the Division to provide by rule for the form, content, application process and renewal process of health spa registration.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments were received in support of or opposing the administrative rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Continuation of the administrative rule is necessary for the Division to administer and enforce the Utah Health Spa Services Act. The administrative rule is required in order for the Division to implement the registration requirement of the Utah Health Spa Services Act.
