NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 62A-15-105(5) gives the Division of Substance Abuse and Mental Health (DSAMH) the authority to develop administrative rules. DSAMH is aware of the flaw in Section 62A-15-606 and is in the process of getting that fixed.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

DSAMH and the Utah State Hospital (USH) have not received any written comments since the last five-year review of this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The USH is continuing this rule that identifies the hospital's responsibility to inform patients and family members of their rights regarding care and treatment while at the USH and possible restrictions of these rights.
