    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 53A-17a-121(2) directs the Utah State Board of Education to develop rules for school districts and charter schools to spend monies for homeless and disadvantaged minority students, and Subsection 53A-1-401(3) allows the Utah State Board of Education to adopt rules in accordance with its responsibilities.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    State law continues to require that the Utah State Board of Education have a rule for school districts and charter schools regarding spending monies for homeless and disadvantaged minority students which provides necessary procedures and criteria. Therefore, this rule should be continued.
