    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Section 53A-17a-120 directs the Utah State Board of Education to adopt rules for the expenditure of funds appropriated for accelerated learning programs, and Subsection 53A-1-401(3) allows the Utah State Board of Education to adopt rules in accordance with its responsibilities.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    State law continues to require that the Utah State Board of Education have rules for the expenditure of funds for accelerated learning programs. This rule provides necessary standards for gifted and talented programs. Therefore, this rule should be continued.
