    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    This rule is enacted under Title 26-8a. Licensure for EMS providers, including ambulance services, are needed for first responders and patient transport in the emergency medical system. Licensure allows immediate medical scene response for patient care, and a regulated system for ambulance quality and access.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No comments, except those received during the previous amendment for ambulance agreements in over-lapping service areas, have been received. That rule was replaced by an emergency rule which will soon be replaced with an amended rule.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The licensure of paramedic services, and all ambulance types, is critical for immediate patient care and patient transport in an efficient system. The Utah Department of Health (UDOH) has considered past opposing comments and replaced disputed language with an emergency rule. UDOH is in the process of re-amending the opposed language.
