DAR File No.: 30352
Filed: 08/21/2007, 11:58
Received by: NLNOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
The division is authorized by Section 62-A-107 to establish administrative rules. Section 62A-3-301 et seq. authorizes the division to provide Adult Protective Services. The purpose of this rule is to define services provided by the Adult Protective Services Unit. It also establishes procedures by which this program will operate.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comments have been received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
There has been no opposition to the rule and Adult Protective Services' functions are critical to the protection of Utah's most vulnerable seniors, in addition to being required and by Section 62A-3-301 of the Older Americans Act. The division will be submitting some changes to the existing rule to bring it into compliance with legislative clarifications and improved practices. Therefore, this rule should be continued.
