    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 53A-16-101.5(3)(c) allows the Utah State Board of Education (Board) to adopt rules regarding the time and manner in which the student count shall be made for allocation of school LAND trust funds, and by Subsection 53A-1-401(3) which allows the Board to adopt rules in accordance with its responsibilities.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comment has been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule continues to be necessary because it provides standards and procedures for allocation of School LAND Trust monies to schools and oversight of appropriate expenditure of monies. Therefore, this rule should be continued.
