    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Section 26-1-5 grants the Department of Health the power to adopt, amend, or rescind rules that shall have the force and effect of law. Section 26-18-3 requires the department to implement the Medicaid program through administrative rules. In addition, 42 CFR 440.60 authorizes licensed practitioners to perform medical or remedial care or services within the scope of practice as defined under state law.

    No written or oral comments have been received regarding this rule.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule is necessary because it outlines program access requirements and service coverage for children under age 21, who qualify for psychology services under the Early and Periodic Screening, Diagnosis and Treatment (EPSDT) program.
