These amendments are to implement clarifying language, particularly within Subsection R501-12-5(7)(i). These changes better clarify statutory intent for who capacity exceptions apply to. It also adds an "or" as originally intended, but omitted from the original rule filing to Subsection R501-12-4(4)(c)(i). The lack of the word "or" was causing a great deal of frustration and confusion for providers. The definition of "child" is clarified to align with the current practice that allows the Division of Child and Family Services (DCFS) initiated placements into foster homes for children no longer in custody (for example adopted children in need of respite care).
