Justification


Regular rulemaking procedures would place the agency in violation of federal or state law.

Justification: This rule is required by S.B. 269 from the 2014 General Session. S.B. 269 requires the Division of Finance to establish a change date of no later than 01/02/2016 for Annual Leave II. This rule will be submitted through the regular rulemaking process but will not become effective prior to the required change date in S.B. 269. Therefore, Finance is submitting this rule as a 120-day emergency rule in order to have the rule in place prior to 01/02/2016.
