Section 26-1-5 grants the Department of Health the power to adopt, amend, or rescind rules that shall have the force and effect of law. In addition, 42 CFR Part 456 requires the evaluation of each resident's need for admission.

The Department of Human Services commented that the rule needed to be amended to clarify requirements. The Department of Health has addressed this concern with several amendments to the rule over the past five years.

This rule is necessary because it outlines provisions for preadmission screening and annual resident review. Therefore, this rule should be continued.
