    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Pursuant to Subsection 53-2a-702(2), the Department of Public Safety has primary responsibility for all emergency planning activities under the federal Emergency Planning and Community Right To Know Act of 1986, and shall prepare policy and procedure and make rules necessary for implementation of that act.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received during and since the last five-year review of this rule from interested persons supporting or opposing the rule.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    A continuation of this rule is necessary because it establishes a state hazardous chemical emergency response commission advisory committee, and sets minimum rules for the creation, modification or dissolution of local emergency planning committees, as well as the supervision of the overall planning and direction of the local emergency planning committees.
