    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 19-5-104(1) authorizes the Water Quality Board to enact rules for construction loans, including development of a priority schedule for awarding loans. Section 35.3115 40 CFR requires that one of the qualifications for awarding those loans is ranking on the project priority list. This rule establishes the process for developing the project priority list.

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The priority ranking system is used to rank wastewater projects for possible state and federal funding assistance. It is a needed component of the state wastewater project assistance program, and should be continued.
