    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 4-2-2(1)(i) requires the Department to write rules to implement the agricultural laws of the state. Subsections 4-2-2(1)(k)(i) and (ii) require the Department to inspect any places that might become infected with harmful insects and to establish quarantines if necessary. Such actions require that a rule be in place

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    All comments received from Utah corn growers indicate support for the rule.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This quarantine helps the department ensure that corn imported into Utah for feed is not infested with European corn borers. Therefore, this rule should be continued.
