Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Section 53-7-204 specifically authorizes the Fire Prevention Board to enact rules and establish minimum standards for the prevention of fire and for the protection of life and property against fire and panic in state-owned facilities, institutional occupancies, public and private schools, colleges and universities, and other places of assembly.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
Rule R710-4 has been amended nine times since the last five-year review in 2002. There were two written comments received to the enacted rule, both on the accepted use of "Time Out Rooms" for those needing behavioral adjustments. The Board made changes to the currently adopted rule on "Time Out Rooms" to be consistent with the currently adopted Risk Management and Utah State Office of Education standards. The two comments received came from State Risk Management and the Utah State Office of Education requesting consistency in the rule application. The Board then made those amendments to be consistent.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
R710-4 provides a minimum degree of fire and life safety in any publicly-owned building, public and private schools, colleges and universities, institutional occupancies to include asylums, jails, prisons, hospitals, and any place of assembly where 50 or more people may gather for amusement, entertainment, instruction or education. This rule has tremendous impact on fire and life safety in many occupancies throughout the State of Utah, where people gather together in assemblage, are restricted to leave a facility as they desire by restraint or impairment, or where children are gathered together for educational purposes or day care. This rule should be continued for it's important requirements in fire and life safety.
