    Section 26-1-5 grants the Department of Health the power to adopt, amend, or rescind rules that shall have the force and effect of law, and Section 26-40-105 authorizes the Department to determine benefits and administration for the Children's Health Insurance Program.

    The Department did not receive any written or oral comments regarding this rule.

    This rule is necessary because it describes the benefits, limitations, providers, reimbursement, and cost sharing for the Children's Health Insurance Program. Therefore, this rule should be continued.
