    This rule has been established under the authority of Title 73, Chapter 5a. The statute specifically directs the State Engineer to establish these rules in order to define the design standards, as well as construction and abandonment requirements for dams.

     

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received.

     

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    Title 3, Chapter 5a, specifically directs the State Engineer to establish these rules. In order to implement the requirements of the statute, the rules need to be continued.
