    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Section 26-1-5 grants the Department of Health (Department) the authority to adopt, amend or rescind rules as necessary to implement the Medicaid program, and Section 26-18-3 requires the Department to implement the Medicaid program through administrative rules. Additionally, 42 U.S.C. 1395x(dd) authorizes coverage for hospice care services.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    The Department did not receive any written comments regarding this rule.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The Department will continue this rule because it sets forth eligibility, access, and coverage for Medicaid clients. The Department will also continue this rule because it includes provisions for concurrent care, in-home care, general care, respite care, continuous care, adult client rights, notices, discharge, payment, contracts, enrollment, marketing, and waivers.
