The Division is authorized under Section 53-3-104 to create rules to consider the record of a licensee upon an application for renewal of a license or at other appropriate times.

No comments have been received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
As authorized under Section 53-3-14 and as specified in Section 53-3-221, the Division is obligated to afford hearings to those whose privilege has been withdrawn. This rule specifically pertains to commercial motor vehicle operators licensed in Utah or who have committed a violation in Utah which would require action. Therefore, this rule should be continued.
