Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Sections 62-A-101 and 62-A-106 authorize the Office of Licensing to make rules to establish basic standards for licensees.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No comments were received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Residential support programs arrange for or provide the necessities of life as a protective service to individuals or families who are experiencing a dislocation or emergency which prevents them from providing these services for themselves or their families. Treatment is not a necessary component of residential support, however treatment shall be made available on request. Therefore, this rule should be continued.
