Section 26-1-5 grants the Department of Health the power to adopt, amend, or rescind rules that shall have the force and effect of law, Section 26-18-3 requires the Department to administer the Medicaid program, and 42 CFR 440.70 authorizes licensed personnel to provide home health services.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule is necessary because it implements the provision of personal care services for Medicaid clients. It also allows licensed registered nurses and personal care aides to provide these services regularly, to maintain the comfort and dignity of homebound clients. Therefore, this rule should be continued.
