This rule is promulgated under Sections 4-2-102 and 4-35-109, which allows the Department of Agriculture and Food (Department) to make and adopt rules that conform to the regulations to control for insect infestations.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments have been received by the Department since the last five years review of this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is necessary for the state to treat areas to prevent the growth of gypsy moths in the state of Utah. This is also necessary to protect the fruit industry in the state of Utah. Therefore, this rule should be continued.
