Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 35A-4-205 lists types of work that are exempt under the Employment Security Act. The Department has authority under Subsections 35A-1-104(1) and (4) and 35A-4-502(1)(b) to adopt rules and establish eligibility standards. The rule is necessary to describe how to determine if an employee is exempt.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments have been received during the last five years.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The rule is necessary to provide guidance to employer and claimants in determining when certain types of employment are exempt such as agricultural workers, outside sales, real estate agents, and family members. Therefore, this rule should be continued.
