NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Subsection 53C-1-302(1)(a)(ii) and Title 53C, Chapter 2, authorize the Director of the School and Institutional Trust Lands Administration to establish rules for the issuance of leases and management of trust-owned lands and resources.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments concerning this rule have been received by the agency since it was enacted five years ago.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is vital to the management of the Trust's coal resources and the issuance of leases. It provides the guidelines and procedures to be followed by the agency and third-parties which are consistent and in the best interests of the trust beneficiaries. Therefore, this rule should be continued.
