Subsection 53C-1-302(1)(a)(ii) and Title 53C, Chapter 2, authorize the Director of the School and Institutional Trust Lands Administration to establish rules for the issuance of mineral leases and the management of trust-owned lands and mineral resources.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments for this rule have been received by the agency since it was first enacted five years ago.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The School and Institutional Trust Lands Administration manages approximately 4,400,000 acres of subsurface mineral rights located throughout the State of Utah. This rule applies to the management of the bituminous-asphaltic sands and oil shale resources for the benefit of the respective beneficiaries and sets forth the guidelines by which the agency conducts business and the customer can follow. Therefore, this rule should be continued.
