This rule provides procedures for appropriate access to division records. This rule is authorized by Sections 63-2-204, 63-2-603, 63-2-904, 65A-1-10, and 65A-6-7.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments have been received to date.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The division is the repository for some government records dating back to early statehood, as well as records relevant to current land use authorizations issued by the division. It is appropriate that procedures for access to division records be provided through rulemaking. Therefore, this rule should be continued.
