    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 53A-1-401(3) allows the Utah State Board of Education (Board) to adopt rules in accordance with its responsibilities, Subsection 53A-19-201(1) allows the Board to set standards relating to the use of school lunch revenues, and Subsection 53A-1-402(1)(3) requires the Board to establish rules concerning school productivity and cost effectiveness measures and federal programs.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule continues to be necessary because it provides requirements for school district and charter school policies regarding foods sold outside of the reimbursable meal service time periods. Therefore, this rule should be continued.
