Section 40-6-5 provides for rulemaking authority to the Board of Oil, Gas and Mining and provides the Board with the authority to regulate all operations related to the production of oil and gas and the disposal of salt water and oil field wastes.

Two parties submitted written comments in support of renewal of this rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Without this rule, the state would not have a vehicle to manage the wastes generated in the process of exploration and production of petroleum hydrocarbons in the state. This rule and the board authority extended to the division are the means for proper disposal and handling of these wastes. Therefore, this rule should be continued.
