Subsection 53-3-205(15)(a) requires that the indication of a person's intent to make an anatomical gift under Title 26, Chapter 28, Revised Uniform Anatomical Gift Act, shall be authenticated by the licensee in accordance with division rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Rule R708-38 should be continued because the process to indicate the intent to make an anatomical gift is still required by state statute.
