    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    This rule is enacted under the authority of Section 63A-5-103, which directs the Utah Building Board to make rules necessary for the discharge of duties of the Division of Facilities, Construction and Management (DFCM); and Subsection 63A-5-208(6) which establishes a process for resolving disputes involved with contracts under the Division's procurement authority.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    DFCM and the Utah Building Board have not received written comments, either in support or opposition to Rule R23-26.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    Rule R23-26 establishes a process for resolving disputes involved with contracts under the Division's procurement authority. Therefore, this rule should be continued.
