Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is promulgated by the Division of Plant Industry (Division), within the Department of Agriculture and Food (Department) under authority of Subsection 4-2-2(1)(j) which empowers the Department to make investigations, subpoena witnesses and records, conduct hearings, issue orders, and make recommendations concerning all matters related to agriculture. Authority is also found in Subsection 4-2-2(1)(i) which directs the Department to promulgate rules necessary for the effective administration of the agricultural laws of the state.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments have been received the last five years.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The rule is needed to enforce any violations involving in Title 4, Chapter 11; Title 4, Chapter 12; Title 4, Chapter 13; Title 4, Chapter 14; Title 4, Chapter 15; Title 4, Chapter 16; and Title 4, Chapter 17. Therefore, this rule should be continued.
