Title 26, Chapter 21, Health Facility Licensure and Inspection Act, authorizes the Utah Department of Health to promulgate rules for health care facilities. The Freestanding Ambulatory Surgical Center Construction Rule adopts the current codes and architectural guidelines for construction of Ambulatory Surgical Centers. Without the authority provided, standards for construction of Ambulatory Surgical Centers would not be available.

The agency agrees with the need to continue the rule. The rule ensures proper construction of Ambulatory Surgical Centers. The Health Facility Committee updated and reviewed the rule in 2002.
