No comments have been received by the department since the last five-year review of the rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
It is the intent of this rule to enforce laws and rules relating to the importation, possession, or transportation of domesticated elk into the state or within the state; the inspection of domesticated elk facilities; prevention of the outbreak and control of the spread of disease-causing pathogens among domesticated elk in domesticated elk facilities; prevention of the spread of disease-causing pathogens from domesticated elk to wildlife, other animals, or humans; and if necessary, the quarantining of any domesticated elk. Therefore, this rule should be continued.
