    This rule is promulgated under Section 4-5-17 which allows the department to make rules regarding the processing of food.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No comments have been received by the department since the last five-year review of the rule.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The rule establishes the sanitation and record keeping practices necessary to manufacture and process shellfish in Utah. This rule is necessary not only for producers to sale their product in Utah, but also to be allowed to transport and market their products in other states. Therefore, this rule should be continued.
