Subsection 53A-1-401(3) authorizes the Utah State Board of Education (Board) to adopt rules in accordance with its responsibilities. Subsection 53A-1-402(1)(a)(i) requires the Board to establish rules and minimum standards for the public schools regarding the qualification and certification of educators and ancillary personnel who provide direct student services. No Child Left Behind (NCLB) Pub. L. 107-110, Title 1, Sec. 1119 requires that each local education agency receiving assistance under this part shall ensure that all paraprofessionals shall be appropriately qualified.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule continues to provide standards for paraprofessionals to be appropriately qualified consistent with state and federal law. Therefore, this rule should be continued.
