    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Section 26-21-5 of the Health Facility Licensure and Inspection Act authorizes the Health Facility Committee in the Utah Department of Health to promulgate rules for the operation of mental disease facilities.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received. The Health Facility Committee authorized continuation of this rule on 05/09/2007.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule is authorized by Section 26-21-5 of the Health Facility Licensure and Inspection Act. Currently there are no mental disease facilities in the state. Without this rule, future facilities of this type would not be regulated or licensed. The department agrees with the need to continue the rule.
