This rule is authorized by Section 72-1-201 and is enacted to promote greater public involvement in the highway program of the department through public hearings.

There have been no comments received from interested persons during and since the last five-year review.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule should remain in effect so the department can continue to promote public involvement in the highway program through public hearings and to provide procedures for conducting public hearings. Therefore, this rule should be continued.
