This rule is authorized by Section 41-6a-1602, which directs the department to prescribe conditions of operation that are necessary to protect the safety of highway users.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
There are certain circumstances where a vehicle owner does not have access to a noncritical equipment item which is necessary to pass a safety inspection. This rule allows our agency to permit these types of vehicles on public roadways on a temporary basis. Therefore, this rule should be continued.
