Subsection 31A-2-201(3)(a) authorizes the Insurance Commissioner to write rules to implement the provisions of the Insurance Code, Title 31A. Subsection 63G-4-102(6) authorizes the Department of Insurance (Department) to enact rules affecting or governing adjudicative proceedings. Subsection 63G-4-203(1) authorizes the Department to designate one or more categories of adjudicative proceedings as informal and to proscribe procedures for these informal hearings. Section R590-160-4 designates the categories for informal hearings, and Sections R590-160-7 and R590-160-8 set the rules for proceedings and their review.

This rule is important for the activities of the Department and its regulation of the industry. It sets fair and equitable standards governing administrative procedures. This helps all involved in the process to know what is expected of them and what to expect of the process. Therefore, this rule should be continued.
