    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 62A-5-103(4)(b) requires the Division to establish standards to assure constitutional protections for persons receiving services and behavior interventions are used during the provision of these services.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The Division is required by Subsection 62A-5-103(4)(b) to establish standards to assure that a person with disabilities is not deprived of constitutionally protected rights and prevent abuse or injury when behavior interventions are used. Therefore, this rule should be continued.
