    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 64-13-6(1)f mandates that the Department investigate criminal conduct involving offenders. Section 64-13-10 directs the Department to provide programs as necessary and as required to accomplish its purposes.

    No written comments have been received.

     

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    General requirements governing the use of offenders in undercover roles must be made available and adhered to by other criminal justice entities.
