Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 53-7-407 Implementation -- Effect of part on Model Tobacco Settlement Act and Tobacco Tax and Licensing Act states that the state fire marshal may promulgate rules and regulations, pursuant to Title 63G, Chapter 3, Utah Administrative Rulemaking Act, necessary to effectuate the purposes of this part.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

There have been no written or verbal comments sent to the State Fire Marshals office relevant to this rule in the last five years.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Since the passage of this legislation, and similar legislation across the United States, fires caused by careless use of cigarettes has been reduced by almost 50%.
