    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    This rule is enacted under the authority of Subsection 72-7-108(3)(f) which requires the Department of Transportation to make rules establishing a schedule of rates of compensation for any longitudinal access granted in the interstate highway rights-of-way.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    There have been no written comments from interested persons received during and since the last five year review.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule should remain in effect to establish a schedule of rates of compensation for any longitudinal access granted in the interstate highway rights-of-way, as required by Subsection 72-7-108(3)(f). Therefore, this rule should be continued.
