Section 26-18-3 requires the Department to implement Medicaid policy through administrative rules, which allow the Department to administer long-term care services to nursing facility residents. In addition, 42 CFR 483.10(c)(3)(i) requires nursing facilities to keep a resident's funds over $50 separate from the facility, and in an interest bearing account.

The Department did not receive any written or oral comments regarding this rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule is necessary because it establishes requirements for long-term care facilities to manage and safeguard a resident's personal funds. Therefore, this rule should be continued.
