Title 31A, Chapter 2, authorizes the commissioner to adopt rules to implement the code. Subsection 31A-8-501(8)(c) authorizes the commissioner to identify by rule the counties with a population density of less than 100 people per square mile, independent hospitals, and federally qualified health centers and describe how health maintenance organizations shall use the information and provide enrollees in rural areas with a notice that includes a list of non-HMO contracted medical providers they can use per certain requirements.

There have been no written comments sent to the department regarding this rule within the past five years.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The rule is needed to assure that people living in rural areas have access to adequate heath care services. Therefore, this rule should be continued.
